Use of the site
Eligibility and access
By accessing or using goagamesofficial.in.net (the "Site"), you confirm that you are at least 18 years of age, or the age of majority in your jurisdiction, and that you have the legal capacity to enter into a binding agreement. If you do not meet these requirements, you must not use this Site.
Permitted use
You may access and use the Site solely for lawful, personal, and non-commercial purposes. You agree not to reproduce, distribute, or publicly display any content without prior written consent from Goa Games; use automated tools, bots, or scrapers to extract data; attempt unauthorised access to the Site or its servers; upload malicious code or harmful data; or use the Site in any manner that violates applicable Indian law, including the Information Technology Act, 2000, and rules made thereunder.
Account responsibility
If you create an account on the Site, you are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify Goa Games immediately upon becoming aware of any unauthorised use. Goa Games reserves the right to modify, suspend, or discontinue any feature of the Site at any time and may terminate or restrict your access if you have breached these Terms of Service.
Intellectual property
Ownership of content
All content on the Site, including text, graphics, logos, images, audio clips, game assets, and software, is the exclusive property of Goa Games or its licensors and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and all applicable Indian and international intellectual property laws. No content may be reproduced or exploited without express written permission.
Limited licence to users
Goa Games grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes only. You may not copy, modify, or create derivative works from any Site content; sublicense, sell, or commercially exploit the Site or its content; remove any proprietary notices; or use the Goa Games name, logo, or branding without prior written approval.
User-submitted content
Where the Site permits you to submit or upload content, you retain ownership but grant Goa Games a worldwide, royalty-free, perpetual, and sublicensable licence to use, reproduce, and display it in connection with operating and promoting the Site. You warrant that any content you submit does not infringe any third-party intellectual property rights. Third-party trademarks or logos appearing on the Site belong to their respective owners and imply no endorsement by Goa Games.
Limitation of liability
Disclaimer of warranties
The Site and all content and services provided through it are offered on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Goa Games expressly disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted under applicable law.
Limitation on damages
To the maximum extent permitted by applicable law, Goa Games, its directors, officers, employees, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages; loss of profits, revenue, data, or goodwill; damages arising from unauthorised access to your data; or damages resulting from reliance on any content obtained through the Site. This limitation applies regardless of the legal theory under which the claim is brought, even if Goa Games has been advised of the possibility of such damages.
Indemnification
You agree to indemnify, defend, and hold harmless Goa Games and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of your use of the Site, your breach of these Terms, or your violation of any third-party rights. In no event shall the aggregate liability of Goa Games to you exceed the amount you paid to Goa Games in the twelve months preceding the event, or ₹1,000, whichever is greater.
Governing law
Applicable law and jurisdiction
These Terms of Service and any dispute or claim arising out of or in connection with them, including non-contractual disputes, shall be governed by and construed in accordance with the laws of India, without regard to its conflict-of-law provisions. The courts of competent jurisdiction located in Goa, India shall have exclusive jurisdiction over any legal proceedings relating to these Terms or your use of the Site.
Dispute resolution
Before initiating formal legal proceedings, you agree to first contact Goa Games in writing and allow a period of thirty (30) days for the parties to attempt to resolve the dispute amicably. If the dispute cannot be resolved informally, either party may pursue resolution through arbitration conducted in English under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Goa, India. Nothing in this clause prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction.
